Uponor Pex Pipe Lawsuit
A New York uponor pex pipe manufacturer was found guilty of criminal liability for allowing its employees to be careless when they filled the water tank of a large commercial water heater with polyethylene (EPDM). The results of the investigation showed that the EPDM that was used contained two different chemicals that were not supposed to be combined. When the employees filled the tank, the amount of the chemicals increased significantly and soon became concentrated within the water heater. The company’s engineers had not noticed the problem and did not notify the state or EPA about the accident. As a result, the employees continued to use the water without any additional protection. When the temperature outside reached ninety degrees, the water in the heater exploded, resulting in the death of all of the occupants of the home.
The EPA is attempting to hold the uponor pex pipe manufacturers responsible for this tragic accident.
The corporation has hired a group of attorneys who are attempting to have the case thrown out due to negligence. This decision will depend on whether or not the EPA can prove negligence on the part of the corporation. If the EPA can prove the negligence, they might have a chance of getting compensation from Onor Pex, however, if they cannot prove the negligence there is no way they will be able to recover their losses. There are many factors that come into play when an accident like this occurs and the EPA has to use every step necessary to be successful in this matter.
The company’s engineers were not responsible for monitoring the proper levels of chemicals in the water supply.

This all comes back to education.
